Please read these Terms of Service ("Terms") carefully before using the Visual Discovery API, website, or services operated by Visual Discovery Inc. ("us", "we", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, developers, and others who access or use the Service.
Account & API Keys
To access our API, you must register for an account. You agree to provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of the Terms.
Security Responsibility
You are responsible for safeguarding the API keys that you use to access the Service. You agree not to disclose your API key to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
Acceptable Use
You agree not to misuse the Visual Discovery services. Specifically, you must not:
- Reverse engineer, decompile, or disassemble any aspect of the API or Models.
- Use the API to create a competing service or product.
- Send automated requests that exceed the rate limits of your subscription plan ("spamming").
- Upload images containing illegal, obscene, or harmful content.
Intellectual Property
Our Rights
The Service, including its original content (excluding Content provided by users), features, AI models, and functionality are and will remain the exclusive property of Visual Discovery Inc.
Your Rights
You retain all rights to the images and data you upload to the API. We claim no ownership over your data. We only process it to provide the service to you.
Billing & Cancellation
Paid plans are billed in advance on a monthly or annual basis.
- Upgrades: Effective immediately, prorated for the remaining cycle.
- Downgrades: Effective at the end of the current billing cycle.
- Refunds: Payments are generally non-refundable, except as required by law.
Limitation of Liability
In no event shall Visual Discovery, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
Note: AI outputs are probabilistic. We do not guarantee 100% accuracy of object detection or search results.
